The publicity photo has no photographer credits or copyright markings. It appears to have been given to someone by Penna in response to an autograph request, and is likely a publicity photo he himself distributed to fans and possibly also to the media. Other photos I have seen of Toney Penna were taken by various newspapers and news organizations. Because of this, they would fall into the "non-free" image category when used on Wikipedia.

It was created for publicity purposes-distribution to the public and likely the media, the same as the publicity photos for actors and actresses in the film industry were intended to do.
